For over twenty years, Mr. Milby has been helping clients resolve corporate, partnership, real estate, construction, and a wide variety of other commercial and contract disputes. His primary practice area is business litigation. Much of that litigation involves disputes within a business such as shareholder disputes, partnership disputes or membership disputes where one party is claiming “minority oppression” or “freezeout/squeezeout” by a majority of the business owners or violations of the fiduciary duties that business partners owe to the company and each other. These cases are often called “business divorce” cases or “dissolution” cases because the business owners often end up going their separate ways either by settlement, splitting up or partitioning the business, dissolving or closing down the business, or because one party receives a cash payment or buyout to leave the business (Business Divorce). Additionally, much of his practice is devoted to disputes between businesses primarily in construction and real estate issues.
Mr. Milby has had remarkable success in jury trials, bench trials and arbitration matters. Within a week after receiving his license to practice, he tried his first bench trial and has been trying cases ever since. However, in this day and age, with clients preferring to avoid the expense and uncertainty of litigation, more than 90% of all business cases result in negotiated settlements. Thus, Mr. Milby has focused much of his professional development on the art, and science, of successful negotiation. Those skills, backed up by an ever-present willingness to take an adversary all the way through trial and a successful litigation track record, regularly enable him to achieve the best possible result for the client while avoiding the expense and distraction of protracted litigation.
